1. Agreement
Welcome to TuliPrint. This site (the “Site”) is operated by PrimeCommerce LLC (“TuliPrint,” “we,” “us,” or “our”). By using the Site or placing an order, you (“you,” the “customer”) agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Site.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract to place an order. If you place an order on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
3. Orders and pricing
Prices, availability, and product specifications shown on the Site are subject to change without notice. An order is accepted only when we send a written order confirmation; before that, we may decline, hold, or adjust an order — for example, when artwork is missing or unproducible, when a configuration falls outside our equipment’s tolerances, or when a pricing error is identified. If we cancel an order before production starts, we refund any amount paid.
4. Custom-print products are non-returnable
Most products on TuliPrint are produced to your specifications and your artwork. Because they cannot be resold, custom orders are non-refundable for taste, change of mind, or buyer’s remorse once production has begun. We will reprint or refund where the order is defective, misprinted, or arrived damaged — see our full Returns & reprints policy.
5. Artwork, content, and intellectual property
You warrant that any artwork, logos, photographs, text, or other content you upload or submit (“Your Content”) is owned by you or licensed to you with the necessary rights to reproduce it for your order, and that producing it does not infringe any third party’s intellectual property, privacy, or publicity rights, and does not violate any law.
You grant TuliPrint and its production partners a limited, non-exclusive license to copy, format, store, transmit, and reproduce Your Content solely for the purpose of fulfilling your order, performing reprints, and maintaining records. We do not claim ownership of Your Content.
You agree to indemnify and hold TuliPrint and its officers, employees, contractors, and production partners harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of Your Content or your breach of these Terms.
6. Acceptable use
You may not use the Site or our services to order content that:
- Infringes another party’s intellectual property, trademark, or right of publicity;
- Is unlawful, fraudulent, defamatory, or invasive of privacy;
- Promotes hatred or violence against any individual or group;
- Depicts sexually explicit content involving minors;
- Contains malware or attempts to disrupt our systems.
We may refuse, hold, or cancel any order at our sole discretion if we reasonably believe it violates this section. We do not pre-screen content and our decision to print is not an endorsement.
7. File accuracy is your responsibility
We print what you send. You are responsible for proofreading your artwork, confirming sizing, color mode (we print in CMYK), and overall layout before approving the order. We are not liable for errors in spelling, dimensions, color, or content present in files you supplied and approved.
8. Turnaround estimates
Production and shipping times shown on the Site are estimates, not guarantees, except where we explicitly offer a guaranteed-by date in writing. We are not liable for delays caused by carrier issues, weather, labor disruption, or other circumstances outside our reasonable control.
9. No warranties
Except as expressly stated in these Terms or in our Returns & reprints policy, the Site and our products are provided “as is” and “as available,” without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.
10. Limitation of liability
To the maximum extent permitted by law, in no event shall TuliPrint, its officers, employees, contractors, or production partners be liable to you for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunity, arising out of or related to your use of the Site or any order, even if advised of the possibility of such damages.
Our total cumulative liability for any claim arising out of or related to an order is limited to the greater of (a) the amount you actually paid for the order giving rise to the claim, or (b) USD $500. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.
11. Governing law & dispute resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site that cannot be resolved through good-faith discussion will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in English, and judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. You and TuliPrint agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
This section does not prevent either party from seeking injunctive relief in a court of competent jurisdiction for misuse of intellectual property.
12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above will reflect the most recent revision. Material changes will be communicated by email to customers with active orders. Your continued use of the Site after a change constitutes acceptance of the revised Terms.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
